Terms of Service

These terms of service ("Terms") govern your use of the Sproggo website at sproggo.co.uk and any associated services (together, "the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
"We", "us", and "our" refer to Sproggo. "You" refers to anyone who accesses or uses the Service, whether as a parent, carer, activity provider, or visitor.
What Sproggo Is
Sproggo is a directory that helps parents and carers find children's activities near them. Activity providers can list their classes, sessions, and events on Sproggo so that families can discover them.
Sproggo is a directory, not an activity provider. We connect parents with providers but we do not run, organise, or supervise any of the activities listed on the Service. The contract for any activity you book is between you and the provider. We are not a party to that contract.
Where the Service allows you to book or join a waitlist through Sproggo, we act as an intermediary to facilitate the transaction. The provider remains responsible for delivering the activity.
Your Account
You may browse Sproggo without creating an account. To book activities, save favourites, or list activities as a provider, you will need to create an account.
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Keep your login details secure and not share them with anyone else
- Let us know promptly if you suspect any unauthorised use of your account
- Accept responsibility for all activity that occurs under your account
You must be at least 18 years old to create an account. Accounts are for individuals. Each person should have their own account.
You can delete your account at any time through your account settings or by emailing us at hello@sproggo.co.uk. When you delete your account, we will erase your personal data in accordance with our Privacy Policy.
Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service in any way that breaks any applicable local, national, or international law or regulation
- Submit false, misleading, or fraudulent information, whether in a listing, review, booking, or account
- Impersonate any person or misrepresent your affiliation with a person or organisation
- Use the Service to send unsolicited advertising or spam to other users
- Attempt to gain unauthorised access to the Service, other users' accounts, or any connected systems or databases
- Use automated tools (bots, scrapers, or similar) to access or collect data from the Service without our written permission
- Interfere with or disrupt the Service or the servers and networks that host it
- Post or transmit any material that is defamatory, obscene, threatening, abusive, or otherwise objectionable
- Use the Service to collect personal data about other users without their consent
We reserve the right to suspend or terminate your account and remove content if you breach these terms.
Bookings and Payments
Some providers allow you to book directly through Sproggo. Others use their own booking system, in which case we link you to their website or platform. The terms below apply to bookings made through Sproggo.
Bookings through Sproggo
When you book an activity through Sproggo, you are entering into a contract with the activity provider, not with Sproggo. We facilitate the booking but are not responsible for delivering the activity.
It is your responsibility to check the details of an activity (including age suitability, location, time, price, and the provider's cancellation policy) before booking. By completing a booking, you confirm that you have read and agree to these Terms and the provider's cancellation policy as displayed at the time of booking.
External bookings
Where a provider uses their own booking system, we simply link you to it. Your booking, payment, and any data you provide are handled entirely by the provider and their chosen platform. Sproggo has no involvement in the transaction and accepts no responsibility for it. Any issues with an external booking should be raised directly with the provider.
Payments
Payments for activities are processed securely through Stripe. Your payment goes directly to the activity provider. Sproggo does not hold, handle, or have access to your funds at any point. We may deduct a platform fee from the provider's payment for facilitating the booking. This fee is not charged to you. We do not store your full card details. By making a payment, you agree to Stripe's terms of service.
The price shown at the time of booking is the price you will be charged. All prices are in pounds sterling (GBP) and include VAT where applicable.
Free activities
Many activities on Sproggo are free. Where no payment is required, you may still need to book a place. Booking a free activity does not create any financial obligation.
Cancellations and Refunds
This section applies to bookings made through Sproggo. If you booked through a provider's own system, their terms apply.
Each activity provider sets their own cancellation and refund policy. You should check the provider's cancellation terms before booking.
If you cancel
You can request a cancellation through the Service. Refunds are issued by the activity provider and returned to your original payment method. Whether you receive a refund, and the amount, depends on the provider's cancellation policy.
If the provider cancels
If a provider cancels an activity you have booked, the provider is required to offer you a full refund of the amount you paid. As Sproggo does not hold your funds, we cannot process refunds ourselves. If you have difficulty obtaining a refund from a provider, you may wish to contact your bank or card issuer.
Your statutory rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Activity Providers
If you list activities on Sproggo as a provider, these additional terms apply to you:
Provider verification
To list paid activities on Sproggo, you must complete identity verification through our payment processor. This includes providing valid identification and bank account details. Payouts for new provider accounts may be subject to a holding period before funds are released.
We reserve the right to delay or withhold payouts where we reasonably suspect fraudulent activity, until the matter is resolved. If we determine that a listing is fraudulent, we may immediately suspend your account, withhold pending payouts, and report the matter to the relevant authorities.
Your listings
- You are responsible for the accuracy of your listings, including activity descriptions, ages, times, prices, and availability
- You must keep your listings up to date. If an activity is cancelled or changes, you must update or remove your listing promptly
- Listings must not contain false or misleading claims about your activities
- New listings are reviewed before they go live. We may reject listings that do not meet our standards
- You must hold any licences, insurance, and qualifications required to run your activities, including appropriate DBS checks where required by law
AI-assisted listing tools
We offer tools that use artificial intelligence to help you write activity descriptions and structure your listings. When you use these tools, the details you provide are sent to a third-party AI service. You are responsible for reviewing and approving any AI-generated content before it is published. AI-generated content is treated the same as any other listing content under these Terms.
Your obligations
- You must honour bookings made through Sproggo at the price shown at the time of booking
- You are responsible for the safety and supervision of participants during your activities
- You must comply with all relevant laws and regulations, including safeguarding, health and safety, and data protection
- You must have a clear cancellation and refund policy and display it in your listing
- You are responsible for issuing refunds to parents in accordance with your cancellation policy. This obligation continues even if your listing is removed or your account is suspended
- You are responsible for recording attendance accurately where the Service provides attendance tracking features
How we use your listings
By listing on Sproggo, you agree that we may use your listing content (including descriptions, images, and activity details) to promote your activities and the Service. This includes featuring your listings on our website, in emails, on social media, and in other marketing channels. We will always link back to your listing on Sproggo where possible. If you remove your listing or close your account, we will stop using your content in new marketing materials. Content that has already been published or distributed before removal does not need to be recalled.
Listing removal
We may remove or suspend any listing that breaches these Terms, contains inaccurate information, or that we reasonably believe may pose a risk to users. We will try to give you notice before doing so, but we may act immediately where there is a safety concern.
If we remove or suspend a listing, the provider remains responsible for honouring or refunding any existing bookings.
Subscriptions and billing
Some features require a paid subscription. Subscriptions are billed through Stripe and renew automatically until cancelled. You can cancel your subscription at any time from your provider dashboard. Cancellation takes effect at the end of your current billing period. If your subscription lapses, your listings remain on the Service but premium features will no longer be available.
User Content
"User Content" means anything you post, upload, or submit through the Service, including ratings, photos, and listing information.
You keep ownership of your User Content. By posting it on Sproggo, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content as part of the Service and in our marketing and promotional materials (for example, featuring a review on our website, in emails, or on social media). When we use your content in marketing, we will only identify you by your first name and the initial of your surname.
If you delete your content or close your account, we will stop using it in new marketing materials. However, content that has already been published or distributed before deletion (for example, a sent email, a social media post, or printed materials) does not need to be recalled.
You are responsible for any User Content you post. You must not post content that:
- Is false, misleading, defamatory, abusive, threatening, or discriminatory
- Infringes anyone else's intellectual property rights, privacy, or other rights
- Contains personal data about someone else without their consent, especially data about children
- Contains advertising, spam, or promotional material unrelated to the listing
We may remove User Content that breaches these Terms at our discretion.
Intellectual Property
All content on the Service that is not User Content, including the design, text, graphics, logos, icons, images, and software, is owned by Sproggo or our licensors and is protected by copyright and other intellectual property laws.
You may view and use the Service for your own personal, non-commercial purposes. You must not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.
The Sproggo name and logo are our trademarks. You may not use them without our prior written consent.
Some images on the Service are provided by Unsplash under the Unsplash licence. Photographer attribution is displayed alongside these images.
Third-Party Links and Services
The Service may contain links to third-party websites, including provider websites, booking platforms, and social media pages. We have no control over the content or availability of those sites and do not accept responsibility for them. A link does not mean we endorse that website.
Where a provider uses a third-party booking system, your use of that system is subject to the third party's terms, not ours.
Disclaimers
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will always be available, uninterrupted, or error-free. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
While we take reasonable steps to verify provider information, we do not independently check every listing. We do not guarantee the accuracy, completeness, or quality of any activity listing, review, or other content on the Service.
We do not vet, endorse, or certify any activity provider. It is your responsibility to satisfy yourself that an activity is suitable and safe for your family. We recommend checking that providers hold appropriate insurance, qualifications, and safeguarding checks before attending any activity.
If you are a provider, you acknowledge that Sproggo is one channel through which families may discover your activities. We do not guarantee any level of visibility, bookings, or revenue. You should not rely on the Service as your sole means of taking bookings or communicating with parents.
Limitation of Liability
To the extent permitted by law, Sproggo is not liable for:
- The quality, safety, legality, or suitability of any activity listed on the Service
- The conduct, actions, or omissions of any activity provider or other user
- Any loss or damage arising from your attendance at an activity found through the Service
- Any indirect, incidental, special, or consequential loss or damage, including loss of profit, data, or opportunity
- Any loss arising from circumstances beyond our reasonable control
- Any loss of bookings, revenue, or business opportunity resulting from service downtime, errors, or changes to the Service
Where we facilitate a booking, our total liability to you for any claim arising from that booking is limited to the amount of any platform fee we received in connection with that booking.
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under English law
Indemnity
If you are an activity provider, you agree to indemnify and hold Sproggo harmless from any claims, losses, or damages (including legal costs) arising from your listings, the activities you provide, or your breach of these Terms. This does not apply to the extent that a claim is caused by our negligence.
Suspension and Termination
We may suspend or terminate your access to the Service, or remove your account, if:
- You breach these Terms
- We reasonably believe your account is being used fraudulently or in a way that may harm other users
- We are required to do so by law
- We decide to discontinue the Service or any part of it
Where possible, we will give you reasonable notice before suspending or terminating your account. If your account is terminated, you may lose access to any data, content, or bookings associated with it.
You can stop using the Service and delete your account at any time. Termination does not affect any rights or obligations that arose before termination (for example, any outstanding bookings or payments).
Disputes Between Users
If you have a dispute with an activity provider about a booking, activity, or refund, you should try to resolve it directly with the provider first. Sproggo is not responsible for resolving disputes between parents and providers, but we may choose to help where we can.
If you believe a listing is inaccurate, misleading, or may put users at risk, you can report it using the report feature on the listing page or by emailing us at hello@sproggo.co.uk. We review all reports and will take action where appropriate.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.
If we make significant changes, we will make reasonable efforts to let you know. For account holders, this may include an email notification. For all users, we will post a notice on the Service.
By continuing to use the Service after changes are made, you agree to the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you may also have the right to bring a claim in the courts of the country where you live. Nothing in these Terms affects your statutory rights as a consumer.
General
- If any part of these Terms is found to be unenforceable by a court, the remaining parts will continue to apply.
- Our failure to enforce any part of these Terms does not mean we waive our right to do so in the future.
- These Terms, together with our Privacy Policy and Cookie Policy, make up the entire agreement between you and Sproggo regarding your use of the Service.
- You may not transfer or assign your rights or obligations under these Terms to anyone else. We may transfer our rights and obligations to another organisation, but this will not affect your rights under these Terms.
